Title
Substitute resolution assigning custody of current and future law-enforcement artifacts and memorabilia to the Milwaukee Police Historical Society ("Historical Society") and allocating space in the Safety Academy to the Historical Society for the storage and display of these artifacts and memorabilia.
Analysis
This substitute resolution provides that the following law enforcement artifacts and memorabilia shall be under the custodianship of the Historical Society:
1. All items currently in the display cases of the Historical Society at the Safety Academy, as well as all items placed in the display cases in these corridors in the future.
2. All items stored at the Safety Academy.
3. All police chief portraits currently located in the "mock court room" (former chapel, Room 109) of the Safety Academy, as well as additional police chief portraits displayed in this room in the future.  Display of these portraits is subject to the approval of the Milwaukee Police Department.
 
This substitute resolution further provides that the following spaces in the Safety Academy shall be assigned to the Historical Society for current and future storage and display of the Historical Society's collection of law-enforcement artifacts and memorabilia:
1. The western corridor of the 1st floor (the corridor which affords access to Room 17) from the entrance to Room 188 south to the southern corridor of the 1st floor (the corridor which affords access to Rooms 158 and 161).
2. The southern corridor of the 1st floor from the western corridor of the 1st floor to the eastern corridor of the 1st floor (the corridor which affords access to Room 182).
3. The eastern corridor of the 1st floor from the entrance to Room 182 south to the southern corridor of the 1st floor, when deemed agreeable by the Milwaukee Police Department.
4. Room B 36 (wood shop).
5. Any additional space as mutually agreeable between the Milwaukee Police Department and the Historical Society.
      
This substitute resolution further provides as follows:
1. That the Historical Society shall, within a reasonable time, vacate the following areas of the 2nd floor of the Safety Academy currently used for storage of items of the Historical Society's collection: Room C (Room 238) and Room D (Room 237) adjoining Room 235 (library), including "newspaper" Room 234 located to the right when entering the library.
2. That the Milwaukee Police Department and the Historical Society may, by mutual written agreement, change the location of items of the Historical Society's collection within the Safety Academy.
3. That the Department of Public Works shall be consulted with respect to any structural or utility modifications to the Safety Academy that may hereafter be required or advised in order to facilitate the administration of this resolution.
4. That this resolution does not indicate or identify the actual owners of the items comprising the Historical Society's collection of law-enforcement artifacts and memorabilia, it appearing that the Historical Society owns some, but not all, of these items.
5. That this resolution does not vest any rights in the Historical Society and may be modified, amended, or repealed at any time.
Body
Whereas, The Milwaukee Police Historical Society ("Historical Society") was incorporated in June 1996; and
 
Whereas, The goals of the Historical Society include: (1) promoting and preserving the rich history of the Milwaukee Police Department; (2) educating the public regarding law-enforcement ideals and history; and (3) increasing awareness of the history of the Milwaukee Police Department through displays, events, publications, tours, lectures, and meetings; and
 
Whereas, To achieve these goals, the Historical Society has collected, preserved, maintained, stored, and displayed a vast collection of law enforcement artifacts and memorabilia at the City of Milwaukee Safety Academy ("Safety Academy"), 6680 North Teutonia Avenue; and
 
Whereas, These artifacts and memorabilia have been acquired by donation or loan from Police Department employees and retirees, as well as their friends and family members and the community at large; an annual inventory will be provided for inspection upon request; and
 
Whereas, The Historical Society's collection of artifacts and memorabilia, including Milwaukee Police Band items jointly maintained by the Historical Society and the Police Band, is currently displayed in wood-framed, glass-doored display cases along the western and southern corridors of the 1st floor of the Safety Academy; and
 
Whereas, These display cases were built for the Historical Society by the Department of Public Works - Bureau of Bridges and Public Buildings (now Buildings and Fleet Division); and
 
Whereas, The Historical Society presently uses Rooms C (Room 238) and D (Room 237) adjoining Room 235 (library), "newspaper" Room 234, and basement corridor off of Room B1, B1-3 of the Safety Academy for storage purposes; and
 
Whereas, The Historical Society anticipates a future need for additional space to display its artifacts and memorabilia collection; and
 
Whereas, In addition to the aforementioned artifacts and memorabilia, the Historical Society wishes to preserve and maintain the collection of former police chief portraits currently displayed in the "mock court room" (former chapel, Room 109) of the Safety Academy; and
 
Whereas, Common Council File Number 71-162-p, adopted July 28, 1972, assigned each room in the then-newly acquired Safety Academy to one of five categories: (1) Police Department jurisdiction; (2) Fire Department jurisdiction; (3) Joint Police/Fire jurisdiction; (4) Mechanical and custodial use (DPW Bureau of Bridges and Public Buildings); and (5) space reserved for future expansion; and
 
Whereas, In addition to allotting space in the Safety Academy to these five categories, File Number 71-162-p also described the corridors, elevators, stairs, and restrooms in the Safety Academy as "exempt" and restrooms in the Safety Academy as "exempt" and "unassignable," thereby indicating that the corridors where the Historical Society's display cases are now located are not under the jurisdiction of any particular City department or other entity; and
 
Whereas, On April 10, 1973, the Common Council adopted File Number 71-162-w, a resolution assigning two unused rooms in the Safety Academy to the Central Board of Purchases; and
 
Whereas, The Common Council's actions in Files 71-162-p and 71-162-w clearly indicate that the Council has the authority to assign space in the Safety Academy to whichever entities it deems to be appropriate occupants; and
 
Whereas, The Common Council finds that the Historical Society's collection of artifacts and memorabilia is invaluable resource for past, present, and future Milwaukee Police Department personnel, as well as for the community at large; and
 
Whereas, The Common Council finds that, in order to ensure the preservation and proper maintenance of the Historical Society's artifacts and memorabilia collection, it is essential that custodianship of the collection be clarified and that specific, secure locations for the storage and display of such items be designated; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the following law enforcement artifacts and memorabilia shall be under the custodianship of the Milwaukee Police Historical Society:
 
1. All items currently in the display cases of the Milwaukee Police Historical Society at the Safety Academy (southern and western corridors on the 1st floor), as well as all items placed in display cases in these corridors in the future.
 
2. All items placed in display cases installed by the Historical Society in the eastern 1st floor corridor of the Safety Academy in the future.
 
3. All items stored in Rooms C (Room 238), D (Room 237) off of Room 235 (library), "newspaper" Room 234 and basement corridor, Room B1-3 of the Safety Academy.  All items currently displayed or displayed in the future in the display cases in the corridor next to Room 210 and cases on the 2nd floor corridor, west side between Rooms 222 and 224.
 
4. All police chief portraits currently located in the "mock court room" (former chapel, Room 109) of the Safety Academy, as well as additional police chief portraits displayed in this room in the future (display of these portraits is subject to the approval of the Milwaukee Police Department); and, be it
5.      
Further Resolved, That, in the event that the Milwaukee Police Historical Society disbands, custodianship of these items shall be transferred to the Society's successor organization subject to approval of the transfer by the Common Council or, if there is no successor, to the City of Milwaukee; and, be it
 
Further Resolved, That the following spaces in the Safety Academy shall be assigned to the Milwaukee Police Historical Society for current and future storage and display of the Society's collection of law-enforcement artifacts and memorabilia:
 
1. The western corridor of the 1st floor (the corridor which affords access to Room 17) from the entrance to Room 188 south of the southern corridor of the 1st floor (the corridor which affords access to Room 158 and 159).
 
2. The southern corridor of the 1st floor from the western corridor of the 1st floor to the eastern corridor of the 1st floor (the corridor which affords access to Room 182).
