Analysis

This resolution confirms the report of the Commissioner of Public Works, as modified by the Common Council Committee, on projects for which Public Hearings have been held.  The resolution authorizes the levying of special assessments and directs the installation and construction of said public improvements.

Body

Whereas, The Common Council of the City of Milwaukee adopted preliminary resolutions, determining it necessary and in the public interest to construct and levy special assessments for the following improvements:

 

1st Aldermanic District

 

N. Teutonia Ave. (Excluding Structure) - W. Ruby Ave. to W. Villard Ave. (ST30681701) (2080-04-70) File Number 960092:  Concrete pavement reconstruction, replace all curb and gutter, replace sidewalk and driveway approaches where needed, sodding, grading, and tree removal where necessary. (Assessable State Aid Fund -- $274,000; Nonassessable State Aid Fund -- $276,000; State or Federal Funds -- $1,680,000; State/Federal Grantor Paving Fund -- $260,000)  These funds are to be transferred to the construction account ST30681710.

 

4th Aldermanic District

 

W. State St. - N. 12th St. to N. 17th St. (ST320031101) (2205-06-70) File Number 030898:  Concrete pavement reconstruction, replace all curb and gutter, replace sidewalk and driveway approaches where needed, sodding, and grading. (Assessable State Aid Fund -- $61,000; Nonassessable State Aid Fund -- $20,000; State or Federal Funds -- $625,000; State/Federal Grantor Paving Fund -- $100,000)  These funds are to be transferred to the construction account ST320031110.

S. 6th St. - W. Ohio Ave. to W. Hayes Ave. (ST32091901) (2235-02-70) File Number 990562:  Concrete pavement reconstruction, replace all curb and gutter, replace sidewalk and driveway approaches where needed, sodding, grading, tree removal where necessary, railroad bridge removal and retaining wall construction, and utility relocation from City acquired abandoned railroad right of way. (Assessable State Aid Fund -- $133,000; Nonassessable State Aid Fund -- $305,000; State or Federal Funds -- $1,320,000; State/Federal Grantor Paving Fund -- $200,000)  These funds are to be transferred to the construction account ST32091910.

 

14th Aldermanic District

 

Alley between E. Dover St., S. Howell Ave., S. Kinnickinnic Ave., E. Potter Ave., and E. Russell Ave. (Westerly North-South, Westerly East-West, and Center North-South Legs) (ST212050108) File Number 030748:  Concrete alley pavement reconstruction, replace some abutting walk or driveway approaches, grading, and storm drainage facilities where needed. (Assessable Alley Paving Fund -- $102,900; Nonassessable Alley Paving Fund -- $36,000)

 

; and

 

Whereas, The report of the Commissioner of Public Works has been filed with the City Clerk; and

 

Whereas, Notices have been sent to all interested persons and public hearings held; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works' Report, as amended at said Public Hearing, is approved and the properties therein identified are benefited; and, be it

 

Further Resolved, That said Commissioner of Public Works is authorized and directed to proceed with said work in accordance with said report pursuant to Section 66.0703 and any other pertinent sections of the Wisconsin Statutes and in the manner directed by Section 115-42 of the Milwaukee Code of Ordinances; and, be it

 

Further Resolved, That the proper departments take such action as is required of them to assess the abutting or adjacent properties and collect such assessment in the manner directed by Section 115-42 of the Milwaukee Code of Ordinances, and, be it

 

Further Resolved, That the City Comptroller is authorized and directed to transfer such funds which are available for this purpose to the appropriate capital Project/Grant accounts; and, be it

 

Further Resolved, That the projects do not involve any parcels of agricultural land which are eligible for deferred special assessments under the provisions of Section 14.30 of the Milwaukee City Charter; and, be it

 

Further Resolved, That the City Engineer and the Commissioner of Public Works are hereby authorized to negotiate and enter into an agreement with the State of Wisconsin, Department of Transportation for the City to undertake construction management duties on the following projects: N. Teutonia Ave. (ST30681701) (2080-04-70), W. State St. (ST320031101) (2205-06-70), and S. 6th St. (ST32091901) (2235-02-70); and, be it

 

Further Resolved, That the City Engineer is authorized and directed to approve and make periodic payments to the State of Wisconsin, Department of Transportation after receipt of invoices from said State for the city's share of the costs for said projects: N. Teutonia Ave. (ST30681701) (2080-04-70), W. State St. (ST320031101) (2205-06-70), and S. 6th St. (ST32091901) (2235-02-70); and, be it

 

Further Resolved, That upon the completion of projects N. Teutonia Ave. (ST30681701) (2080-04-70), W. State St. (ST320031101) (2205-06-70), and S. 6th St. (ST32091901) (2235-02-70); and a determination of the actual costs, it is understood that if the City of Milwaukee's share is less than the amount previously paid, the difference will be refunded to said City; and, be it

 

Further Resolved, That the City Engineer is authorized and directed to approve and make periodic payments to the City of Wauwatosa after receipt of invoices from said City for the City's share of the costs for said project: N. 124th St. (ST211040108); and, be it

 

Further Resolved, That projects N. Teutonia Ave. (ST30681701) (2080-04-70), W. State St. (ST320031101) (2205-06-70), N. 124th St. (ST211040108), W. Lynx Ave. (SW170050117), Alley W. Metcalf Ave. (ST212050129), Alley W. Lapham St. (ST212050104), S. 6th St. (ST32091901) (2235-02-70), and Alley E. Dover St. (ST212050108) will be billed after January 1, 2007, but not before 12 months after the project contract has been completed; and, be it

 

Further Resolved, That project W. Custer Ave. - N. 91st St. to N. 92nd St. (ST211020130) File Number 021755: needs additional funds (Nonassessable Reconstruction Paving Fund -- $4,000); and, be it

 

Further Resolved, That the following projects be deleted from the 2005 Paving Program:
