Title
Substitute resolution approving an Agreement with Milwaukee County relating to the transfer to the City of Milwaukee of the property between 1200 and 1400 East Conway Street in the 14th Aldermanic District.
Analysis
This substitute resolution approves an Intergovernmental Cooperation Agreement between the City of Milwaukee and the County of Milwaukee in which Milwaukee County transfers to the City of Milwaukee title to a 2.6-acre site between 1200 and 1400 East Conway Street in the 14th Aldermanic District.
Body
Whereas, The Wisconsin Department of Transportation (“WISDOT”) determined that the 2.6-acre site between 1200 and 1400 East Conway Street, adjacent to the Lake Parkway and the U.S. Naval Reserve Center, is surplus land from the Lake Parkway and is not needed for transportation purposes; and

Whereas, Milwaukee County (“County”) adopted a resolution (Amended Resolution File No. 04-378) authorizing the County to acquire title to the site from the State of Wisconsin, as provided in a 1986 Agreement between the County and WISDOT regarding land originally acquired to build the Lake South Freeway, and the County resolution further authorized the County to convey title to the City of Milwaukee (“City”) and to enter into the Intergovernmental Cooperation Agreement; and

Whereas, As reflected in the Intergovernmental Cooperation Agreement that is part of this file, and that was negotiated by the City Attorney's Office and the County Corporation Counsel's Office, the County conveyance to the City would be on an AS-IS basis and subject to restrictions limiting the use of the property to public, open, green space and prohibiting building on the property unless consented to by the County, and the City would have to hold the County harmless with respect to the condition of the property; and
