Title
Substitute resolution authorizing and directing the Commissioner of Public Works to execute a project agreement with the Wisconsin Department of Transportation (WISDOT) for the programming and construction of street lighting along South 13th Street between West Rawson Avenue and West College Avenue with Federal/State aid under the Surface Transportation Program (STP).
Analysis
This resolution authorizes and directs the Commissioner of Public Works to execute a Project Agreement with the WISDOT for the programming and construction of street lighting along South 13th Street between West Rawson Avenue and West College Avenue.  This resolution also directs the City Comptroller to transfer funds and establish Project/Grant Chartfield Values for the construction of this project.  The estimated total cost of the project is $125,000, of which the City's share is $8,800.
Body
Whereas, The Common Council of the City of Milwaukee adopted Resolution File Number 030469 authorizing and directing the Commissioner of Public Works to execute an agreement with Milwaukee County for the City's share of preliminary engineering costs associated with the South 13th Street improvement project between West Rawson Avenue and West College Avenue in the Cities of Oak Creek and Milwaukee; and
 
Whereas, The project agreement that Milwaukee County has with the WISDOT for the construction costs associated with the South 13th Street improvement project does not include funding for the construction of a street lighting system; and
 
Whereas, The Cities of Milwaukee and Oak Creek have decided that it is in the best interests of both communities to construct and operate street lights along South 13th Street between West Rawson Avenue and West College Avenue; and
 
Whereas, Street lighting construction costs are an eligible item under Surface Transportation Program funding; and
 
Whereas, The City of Milwaukee has requested and the WISDOT has submitted a Project Agreement to account for the construction costs associated with a new street lighting system as a cost participating item for City execution; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized and directed to execute the Project Agreement with the WISDOT for the programming and construction of street lighting along South 13th Street between West Rawson Avenue and West College Avenue, a copy of which is attached to Common Council Resolution File Number 040977 and incorporated in this resolution by reference as though set forth therein in full; and, be it
 
Further Resolved, That the Commissioner of Public Works is hereby authorized and directed to negotiate and enter into a cost-sharing agreement with the City of Oak Creek for the construction, operation and maintenance costs associated with this project; and, be it
 
Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project/Grant Chartfield Values for the construction costs associated with the project (Expenditure) and transfer to any of these accounts the amount required under the grant agreement and City Accounting Policy but not to exceed a 10 percent increase of the total amounts reserved for the grantor's share and local share or $5,000, whichever is greater, as follows:

Further Resolved, That the City Engineer is hereby authorized and directed to approve and make periodic payments to the WISDOT upon receipt of invoices for the City's share of project costs.
