Title

Substitute resolution authorizing the Commissioner of Public Works to execute an agreement with the Wisconsin Department of Transportation for the funding of the installation of interim street lighting, installation of permanent lighting improvements, and the removal of the interim lighting on portions of West Clybourn Street, West St. Paul Avenue, and adjoining streets in conjunction with Marquette Interchange reconstruction.

Analysis

This resolution authorizes the Commissioner of Public Works to install interim street lighting facilities, to install permanent street lighting facilities and remove interim street lighting facilities on West Clybourn Street/West Tory Hill from North 10^th Street to a point west of North 18^th Street, on West Clybourn Street, from a point east of North 20^th Street to a point west of North 25^th Street on West St. Paul Avenue, from North 5^th Street to a point west of North 6^th Street, and on portions of adjoining streets in conjunction with the next stage of reconstruction of the Marquette Interchange known as the West Contract.  Funding for the construction of the street lighting improvements is to be provided by the Wisconsin Department of Transportation under the Federally funded State Highway Improvement Program as part of the interchange project.

Body

Whereas, the Wisconsin Department of Transportation is reconstructing the Marquette interchange of IH 94, USH 41, IH43, and IH 794 under the State Highway Improvement Program; and

Whereas, The Interchange reconstruction project provides cost participation for street lighting improvements; and,

Whereas, The total estimated cost of street lighting improvements included as part of this project is; $150,050.22; and,

Whereas, A maximum of ten percent of the participating project cost, or $15,005.02, is non-reimbursable and is included in the Division's 2004 Capital Purpose Account, Project/Grant Number ST240040000; and,

Whereas, A minimum of ninety percent of the participating project cost, or $135,045.20, is reimbursable from the Wisconsin Department of Transportation, and should be earmarked for this project in the 2004 Capital Grant and Aid Projects Account, Project/Grant Number SP032040100; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works be and hereby is authorized and directed to execute a contract with the Wisconsin Department of Transportation pertaining to the cost participation for the installation of street lighting improvements, in conjunction with the reconstruction of the Marquette Interchange, on West Clybourn Street/West Tory Hill, from North 10^th Street to a point west of North 18^th Street, West Clybourn Street, from a point east of North 20^th Street to a point west of North 25^th Street, West St. Paul Avenue, from North 5^th Street to a point west of North 6^th Street, and on portions of adjoining streets with unit prices based on a predetermined estimate prepared under the Federal/State aided highway program, a copy of which is attached to Common Council Resolution File Number 040408, and is incorporated in this resolution by reference as though set forth in full; and, be it

Further Resolved, That upon approval of this contract, the Commissioner of Public Works is authorized and directed to install or modify street lighting facilities in conjunction with the paving of these Federal/State aided highway improvements; and, be it

Further Resolved, That upon approval of this contract, the City Comptroller is hereby authorized to create within the Capital Grant and Aid Projects Fund the appropriate Project/Grant Chartfield Value for this project; and transfer to these accounts the amount required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor's share and local share or $5,000.00, whichever is greater, as follows:
