Substitute resolution authorizing the Commissioner of Public Works to issue permits to the Milwaukee Community Service Corps allowing the Milwaukee Community Service Corps to install and maintain temporary artwork at ten intersections within the City of Milwaukee. (DPW)
Analysis
The Milwaukee Community Service Corps plans what it calls an Art Corps Initiative.  This program will provide an opportunity for artists to publicly display their works in highly visible locations around the City.  Each work would be up for a limited period of time and then replaced with another piece.  The Milwaukee Community Service Corps has proposed ten intersections throughout the City where it would like permission to install the art works.  These intersections are listed in the attachment to this resolution.  A review committee set up by Milwaukee Community Service Corps and including a member from the Milwaukee Arts Board, as well as the Common Council member in whose district artwork will be placed, would screen the various art works before allowing them to be installed.  The Commissioner of Public Works would evaluate the artworks and their proposed locations to ensure that public safety and general convenience will be protected.  This resolution authorizes the Commissioner to issue permits to Milwaukee Community Service Corps allowing installation of the various artworks when the Commissioner finds that doing so will not compromise the public interest.

Whereas, The Milwaukee Community Service Corps' (MCSC) mission is to provide training and employment opportunities for young people in the City; and
 
Whereas, Over the years, the City of Milwaukee and MCSC have cooperated on a variety of programs and projects that have been mutually beneficial; and
 
Whereas, MCSC is now proposing what it calls an Art Corps Initiative that will give young artists an opportunity to publicly display their works; and
 
Whereas, MCSC is asking permission to install the artworks on a rotating basis at ten intersections within the City; and
 
Whereas, The ten intersections proposed by MCSC along with the proposed size of the bases for the artwork to be placed at each location are listed in the exhibit attached to this file; and
 
Whereas, The placement of any private improvement within the public right-of-way requires a permit from the City issued through the Commissioner of Public Works; and
 
Whereas, In the case of the proposed artwork, the Commissioner would determine, on an individual basis, whether the installation could in any way compromise the public's safety or general convenience; and
 
Whereas, The Commissioner would only issue the required permit when finding that the location, scale, and configuration of the artwork would create no such potential problems; and
 
Whereas, Prior to requesting a City permit for any individual piece, MCSC would have the artwork reviewed and approved by an independent screening committee; and
 
Whereas, A representative from the City's Arts Board, as well as the Common Council member in whose district artwork will be placed, will be members of the screening committee; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works is hereby granted authority to issue permits to the MCSC for the purpose of installing, maintaining, and removing rotating artwork at the ten intersections listed in the exhibit attached to the file; and, be it
 
Further Resolved, That the Commissioner shall incorporate in the permits reasonable terms and conditions to ensure that the spirit and intent of this resolution is achieved and to assure that the City of Milwaukee is held harmless for any potential liability associated with placement of the artwork in City rights-of-way.
