Title
Resolution designating revised boundaries for the Menomonee Valley Redevelopment Project Area "K" and declaring such area to be a blighted area in need of a redevelopment project.
Analysis
If adopted by two-thirds vote of the Common Council membership, this resolution will expand the boundaries of the Menomonee Valley Redevelopment Project Area "K" to include additional properties West of South 6th Street and will enable the Redevelopment Authority of the City of Milwaukee to proceed with the preparation of a Redevelopment Plan for the enlarged area.
Body
Whereas, In File No. 020573 adopted on August 1, 2002, the Common Council of the City of Milwaukee ("Common Council") approved boundaries for the Menomonee Valley Redevelopment Project Area "K"; and
 
Whereas, The Redevelopment Authority of the City of Milwaukee ("Authority") deems it desirable to include additional properties in this proposed redevelopment area West of South 6th Street; and
 
Whereas, As a first step in the exercise of powers granted for the acquisition and disposition of real property in a project area, Section 66.431, Wisconsin Statutes, as amended, requires that the Authority designate boundaries of a proposed project area to ascertain the names of the owners of record of the real property within such project area which are to be given official public notice and also to submit such boundaries to the Common Council for approval and for a declaration that such area is a blighted area in need of blight elimination and an urban renewal project; and
 
Whereas, On June 17, 2004, the Authority designated boundaries for an enlarged proposed Menomonee Valley Redevelopment Project Area "K," which qualifies as a "blighted area" under Section 66.431(4)(b), Wisconsin Statutes, with a recommendation for subsequent Common Council approval; and
 
Whereas, Section 66.431(6)(b)1., Wisconsin Statutes, also provides that the Common Council may take appropriate action to assure that any new construction or substantial remodeling of existing structures within such boundaries will not substantially prejudice the preparation and processing of a Redevelopment Plan for the proposed project area; and
 
Whereas, The Common Council deems it necessary and in the public interest to undertake activities to eliminate blight, blighting influences, obsolescence and the deterioration of property in the expanded proposed project area for the Menomonee Valley Redevelopment Project Area "K"; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, regarding approval of new boundaries for Menomonee Valley Redevelopment Project Area "K" pursuant to the provisions of Section 66.431, Wisconsin Statutes, that:
 
1. The project area boundaries designated by the Authority, which are more specifically described in Exhibit 1, a copy of which is attached to this Common Council File, are in all respects approved.
 
2. It is declared that the project area designated, by virtue of its present use, obsolescence, deterioration of site and other improvements, substantially impairs or arrests the sound growth of the City and, therefore, is a blighted area in need of an urban renewal project within the meaning of Section 66.431, Wisconsin Statutes.
 
3. The Authority is requested to proceed with the preparation of a Redevelopment Plan and a Relocation Payment and Assistance Plan for the proposed project area, including any and all studies and surveys necessary thereto as may be required by Wisconsin law and to submit such Plan to the Common Council for approval.
 
4. For an initial period not to exceed six months from the date of adoption of this resolution, it prohibits the authorization of any new construction in the proposed project area, except upon resolution by the Common Council as provided in Section 66.431(6)(b)1., Wisconsin Statutes, and in Section 200-36 of the Milwaukee Code of Ordinances, and, therefore, no new construction except ordinary repair or maintenance or improvement necessary to continue occupancy under any regulatory order, shall be authorized by any agency, board or commission of the City of Milwaukee in such area except as herein provided.
 
5. It pledges its cooperation in the preparation of plans incidental to the aforesaid project and requests the various City officials, departments, boards, commissions and agencies having administrative jurisdiction and responsibilities in the premises located within the designated and approved boundaries of the proposed project to likewise cooperate with and to assist, as may be appropriate, the Authority and its duly appointed staff, the Department of City Development.
 
6. The City Clerk is directed to transmit a certified copy of this resolution along with a copy of Exhibit 1 to the Commissioner of Public Works, the Commissioner of the Department of Neighborhood Services, the Commissioner of the Department of City Development and the City Engineer.
