Resolution authorizing conveyance of an easement across City property to the State of Wisconsin Department of Natural Resources for purposes of improving, operating and maintaining the Hank Aaron State Trail. (DPW)
Analysis
This resolution authorizes City officials to execute and convey an easement across City property to the State of Wisconsin Department of Natural Resources. The easement will apply to those segments of Department of Public Works' property in the Menomonee Valley designated to become part of the Hank Aaron State Trail. The City has already constructed a rough trail across its Menomonee Valley properties between Emmber Lane and 25th Street. Via this easement, the Department of Natural Resources will make additional improvements and assume responsibility for operation and maintenance of the trail.

Whereas, For some time the State of Wisconsin Department of Natural Resources (DNR) has been planning and taking the initial steps to develop a bicycle/pedestrian trail through the Menomonee Valley to be known as the Hank Aaron State Trail; and

Whereas, The City of Milwaukee has been involved from the beginning in the planning and related initial steps for the trail; and

Whereas, Plans for the trail show portions of it traversing City property currently used by, and under the jurisdiction of, the Department of Public Works (DPW); and

Whereas, The DPW previously constructed a rough trail across these properties to help start the Hank Aaron Trail development process; and

Whereas, The City and DNR have recently agreed upon a Memorandum of Agreement that sets for the understandings between the two regarding funding, acquisition, development, and operation of the Hank Aaron State Trail through the City; and

Whereas, The Common Council approved the Memorandum of Agreement on July 7, 2004, via Common Council File Number 040006; and
