Resolution declaring a portion of the vacant, tax-deed lot located at 2821 North 1st Street surplus to municipal needs and authorizing its sale to Paul M. Bachowski for use as green space and dedicating the remaining portion as public right-of-way, in the 6th Aldermanic District. (DCD)
Analysis
This resolution will result in the sale of part of a vacant, tax-deed lot for use as green space and dedication of the remaining piece as right-of-way.
Body
Whereas, Paul M. Bachowski has submitted an Offer to Purchase in the amount of $750 part of the vacant, tax-deed lot at 2821 North 1st Street that adjoins his property at 2831 North 1st Street and to use the lot as green space; and

Whereas, Although considered buildable, the lot is not suitable for any development since it is located on a hill and the street dead-ends both north and south of the lot; and

Whereas, The Department of Public Works has requested that a portion of the lot be dedicated for right-of-way to facilitate pedestrian access; and

Whereas, Mr. Bachowski has agreed to landscape and fence part of the lot along with his existing residence; and

Whereas, The Department of City Development (“DCD”) recommends acceptance of said Offer contingent upon approval of Mr. Bachowski's landscape plan prior to closing; and

Whereas, Said part of lot is to be sold in an “as is” condition without representations or warranties including, but not limited to soil quality and subsurface condition; and

Whereas, The City Plan Commission has determined that there is no municipal need for the portion of lot to be sold to Mr. Bachowski and has approved the dedication of a portion as public right-of-way; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that part of the vacant, tax-deed lot located at 2821 North 1st Street is declared surplus to municipal needs, that the Offer to Purchase fro...
