Analysis
This resolution will result in the sale of a vacant, tax-deed lot for use as green space.
Body
Whereas, Christian Union Missionary Baptist Church (“CUMB”), with its properties located at 2152, 2156, 2162, 2166-68 and 2176 North 39th Street has submitted an Offer to Purchase in the amount of $1 the vacant, tax-deed lot located at 2158-60 North 39th Street that adjoins their properties for use as green space and outdoor picnic/play area; and
Whereas, Said lot is located amidst the vacant lots currently owned by CUMB and CUMB needs the lot to facilitate a landscaping plan with outdoor picnic and play area and has submitted a site plan that is acceptable to the Department of City Development (“DCD”); and
Whereas, At closing, DCD recommends that said lot be combined with all contiguous properties under CUMB ownership into one parcel with one tax key number; and
Whereas, DCD recommends acceptance of said Offer; and
Whereas, Said lot is to be sold in an “as is” condition without representations or warranties including but not limited to soil quality and subsurface condition; and
Whereas, The City Plan Commission has determined that there is no municipal need for said lot; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the vacant, tax-deed lot at 2158-60 North 39th Street is declared surplus to municipal needs and that the Commissioner of DCD or designee is authorized to accept the Offer to Purchase from Christian Union Missionary Baptist Church and perform such acts as necessary to carry out the intent of this resolution and close the sale; and, be it
