Analysis
This resolution authorizes execution of an Out-of-Program Agreement between the City and Pier Wisconsin Ltd., the developer of the Pier Wisconsin project. The agreement addresses design, funding, and construction of water main, sewer line, and street improvements required for development of the Pier Wisconsin complex. The City will design the infrastructure improvements and inspect their installation. Funding for the public improvement work will come first from initial lease payments Pier Wisconsin will make to the City under the terms of its lease agreement with the Harbor Commission/City. If additional funds are needed, Pier Wisconsin Ltd. will provide them.

Whereas, Pier Wisconsin Ltd. intends to develop a multi-use complex on City of Milwaukee Harbor Commission land commonly referred to as the Municipal Pier; and

Whereas, Plans for the project will necessitate relocation of existing sewer and water lines as well as realignment of East Michigan Street; and

Whereas, The lease agreement between the Harbor Commission/City and Pier Wisconsin Ltd. stipulates that the City fund all required public improvements up to an amount equal to or less than the value of the initial lease payment; and

Whereas, Pier Wisconsin Ltd. will be responsible for any public improvement costs over and above the initial lease payment amount; and

Whereas, The City's Department of Public Works will design the required alterations in public infrastructure, Pier Wisconsin Ltd. will undertake construction of the public improvements, and DPW will inspect the work; and
