Substitute resolution approving and authorizing the proper City officers to execute an easement agreement between the City of Milwaukee and Juneau Avenue Partners, LLC, the Pabst City Developer, to allow City conduit and manholes to be placed in vacated North 10th Street between West Winnebago Street and West Highland Avenue, in the 4th Aldermanic District.
Analysis
New underground conduit is proposed to be constructed in vacated North 10th Street between West Winnebago Street and West Highland Avenue.  This installation is necessary to re-route existing conduit that will be affected by the removal and reconstruction of several bridges over IH-43 as part of the Marquette Interchange Project.  The City currently uses these bridges to support City conduit over IH-43 thus providing vital City communication links in this area.  Vacated North 10th Street provides a viable route during the Marquette Interchange Project which allows the City's communication system to remain active in this area.  Since vacated North 10th Street is private property, an easement must be granted to the City to allow the conduit and manholes to be constructed.
Body
Whereas, As part of the reconfiguration of the Marquette Interchange, several bridges over IH-43 will be removed and reconstructed which the City currently uses to support conduit packages over the freeway; and
 
Whereas, This conduit package carries cable and fiber that are vital to the City's communication network; and
 
Whereas, Before these bridges can be removed, new conduit has to be installed to support re-routing the cables and fiber; and
 
Whereas, A viable route has been determined which includes crossing private property along vacated North 10th Street between West Winnebago Street and West Highland Avenue; and
 
Whereas, The property owner must grant an easement to the City to allow the conduit to be constructed and maintained; and
 
Whereas, The terms of said easement are set out and attached to this file and approved as to content by the City Engineer and as to form by the Office of the City Attorney; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that said easement be and the same is hereby approved, and the proper City officials be and they hereby are authorized and directed to execute the same on behalf of the City of Milwaukee; and, be it
 
Further Resolved, That after said easement has been executed by the proper City officers, it shall be returned to the City Engineer for recording and proper distribution.
