Minutes note: THE CLERK swore in the Court Reporter: Recommendation of renewal with a 10-day suspension of the Class "B" Tavern license of Anderson McWillie based upon the police report for the premises located at 440 W. Center St. ("AD's Club House") in the 6th aldermanic district. Recommendation of renewal with a 10-day suspension of the Class "B" Tavern and Tavern Dance licenses of LC Whitehead, Agent for "Met Hall Inc. Ink" based upon neighborhood objection for the premises located at 3400 N. Holton St. ("Ret Lounge") in the 6th aldermanic district. Recommendation of renewal with a 90-day suspension of the Class "B" Tavern and Tavern Amusement (Cabaret/Nite Club) licenses for Daniel Goumenos, Agent for "Bailey's, Inc." based upon the police report and neighborhood objection for the premises located at 788 N. Jefferson St. ("Park Bar") in the 4th aldermanic district. Recommendation of renewal with a 90-day suspension of the Public Dance Hall license of James Harrison, Agent for "Teen USA, LLC." based upon noise nuisance for the premises located at 7427 W. Bradley Rd. ("Café H2O") in the 9th aldermanic district. The President questioned whether the members of the Common Council read the Report and Recommendations of the Utilities and Licenses Committee in the matter and any written exceptions? Ayes: 15 - Ald. Hamilton, Davis, D'Amato, Bauman, Bohl, McGee Wade, Donovan, Puente, Murphy, Dudzik, Witkowiak, Witkowski, Zielinski and President Hines. THE CHAIR asked whether the following applicants or their counsel were present and wished to address the Council. Anderson McWillie was not present. LC Whitehead, was present and wished to address the Council. ALD. WITKOWIAK moved that the Common Council do now resolve itself into a Committee of the Whole for the purpose of hearing from LC Whitehead and Assistant City Attorney Bruce Schrimpf relative to recommendation of renewal with a 10-day suspension for the Class "B" Tavern and Tavern Dance license of LC Whitehead for the premises at located at 3400 N. Holton St. ("Ret Lounge") in the 6th aldermanic district. PROCEEDINGS OF THE COMMITTEE OF THE WHOLE LC Whitehead and Assistant City Attorney Bruce Schrimpf appeared and addressed the committee. ALD. WITKOWIAK moved that the Committee do now rise. Daniel Goumenos was not present. ALD. BAUMAN moved to not renew the Class "B" Tavern and Tavern Amusement (Cabaret/Nite club) Licenses for the premises located at 788 North Jackson Street, "Park Bar", in lieu of the 90-day suspension recommended by the Utilities and Licenses Committee. The motion prevailed by the following vote: Ayes: 14 - Ald. Davis, D'Amato, Bauman, Bohl, McGee, Wade, Donovan, Puente, Murphy, Dudzik, Witkowiak, Witkowski, Zielinski and President Hines. Noes: 1 - Ald. Hamilton. ALD. WITKOWIAK moved that the Common Council do now resolve itself into a Committee of the Whole for the purpose of hearing from Attorney Stewart and Assistant City Attorney Bruce Schrimpf relative to the Public Dance Hall license of James Harrison, Agent for "Teen USA, LLC." based upon noise nuisance for the premises located at 7427 W. PROCEEDINGS OF THE COMMITTEE OF THE WHOLE Attorney Marjney Stewart and Assistant City Attorney Bruce Schrimpf appeared and addressed the committee. ALD. Witkowiak moved that the Committee do now rise. ALD. DUDZIK moved for non-renewal of the public dance hall license for the premises located at 7427 W. Bradley Road, "Cafe H20", in lieu of the 90-day suspension recommended by the Utilities and Licenses Committee. ALD. DUDZIK withdrew his motion. ALD. ZIELINSKI moved to suspend the rules on the motion. The motion prevailed by the following vote: Ayes: 10 - Ald. Hamilton, Bauman, Bohl, McGee, Wade, Puente, Murphy, Witkowiak, Zielinski and President Hines. Noes: 5 - Ald. Davis, D'Amato, Donovan, Dudzik and Witkowski. ALD. MCGEE moved to reduce the 45 days. The motion failed by the following vote: Ayes: 3 - Ald. McGee, Wade and President Hines. Noes: 12 - Ald. Hamilton, Davis, D'Amato, Bauman, Bohl, Donovan, Puente, Murphy, Dudzik, Witkowiak, Witkowski and Zielinkski. ALD. DUDZIK reintoduced his motion to recommend non-renewal of the public dance hall license for the premises located at 7427 W. Bradley Road, "Cafe H20." The motion prevailed by the following vote: Ayes: 9 - Ald. Hamilton, D'Amato, Bauman, Bohl, Donovan, Puente, Murphy, Dudzik and Zielinski. Noes: 6 - Ald. Davis, McGee, Wade, Witkowiak, Witkowski and President Hines. ALD. WITKOWIAK moved for approval of the Committee Report as amended.
