Title
Resolution authorizing the Department of City Development to prepare the appropriate documents for the release of deed restrictions imposed by the City of Milwaukee when vacant lots were previously sold to adjoining owners, in the 7th and 17th Aldermanic Districts. (DCD)
Analysis
This resolution will remove a timely delay from vacant lot sales for new residential development in the Lindsay Heights target area, namely North 12th Street, North 20th Street, West Walnut Street and West Locust Street.
Body
Whereas, Sales of vacant lots in the primary and/or secondary Lindsay Heights housing program target area are very successful and many of the parcels being assembled for this initiative were previously sold to adjoining owners for green space; and

Whereas, The City of Milwaukee's (“City”) vacant lot sale program dictates that a restriction be placed in all deeds conveying City property to adjoining owners for green space stating that the vacant lot conveyed shall be joined with the existing privately owned property so as to create a single parcel to be used as a unit; that said combined parcel shall not be divided without the approval of the Common Council of the City of Milwaukee; and that the land therein conveyed shall be used as open space and no principal building may be erected thereon; and

Whereas, Many of the parcels being assembled for residential construction have the above restrictions in the deeds and the title companies will not permit construction due to this restriction; and

Whereas, Whenever parcels located in this designated area and the Department of City Development's (“DCD”) Planning Division deems it appropriate to release such restrictions in the interest of advancing neighborhood redevelopment plans, the Commissioner of DCD or designee may insert the Release of Deed Restriction declaration in the new deed conveying such parcels; now, therefore, b...
