Whereas, The Department of City Development ("DCD") recommends acceptance of said Offer from MHFH, contingent upon site and building plan approval by its planning division; and
 
Whereas, Said lots are being sold in an "as is" condition and the City of Milwaukee makes no representations as to soil or subsoil condition; and
 
Whereas, The City Plan Commission has determined that said lots are surplus to municipal needs; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that said lots are declared surplus, that the Offer from Milwaukee Habitat For Humanity, Inc., is accepted, that the Commissioner of DCD, or assigns, is authorized and directed to perform such acts as necessary to carry out the intent of this resolution and that the proceeds from the sale be credited to the Reserve For Tax Deficit Fund, Account No. 0001-334106.
