Title
Substitute resolution authorizing 50 percent reduction in permit fees relating to temporary occupancy of the public right-of-way during construction at 2050 North Commerce Street.
Analysis
Section 81-102-2-b of the code provides that the permit fees required for the temporary occupancy of the public way for purposes related to construction work on adjacent property may be reduced by 50 percent by resolution of the Common Council if the findings of the Commissioner of Public Works indicate that certain criteria have been met.
This substitute resolution reduces by 50 percent the permit fees required for the temporary occupancy of the public right-of-way relating to the construction by River Homes Partners, LLC of the River Court condominiums development at 2050 North Commerce Street.

Whereas, River Homes Partners, LLC desires a permit for the temporary occupancy of certain public rights-of-way for construction of the River Court condominiums development at 2050 North Commerce Street; and
Whereas, Section 81-102-2-b of the code provides that permit fees required for the temporary occupancy of the public right-of-way for purposes related to construction work on adjacent property may be reduced by 50 percent by resolution of the Common Council if the findings of the Commissioner of Public Works indicate that all the following criteria have been met:
1. Occupancy of the public way will not significantly impact traffic or parking.
2. Soil conditions do not allow for on-site staging based on supporting information supplied by the developer.
3. Maintaining setbacks and site coverage for the proposed development that are consistent with the surrounding neighborhood precludes on-site construction staging; and
