Analysis
This ordinance prohibits a patron from entering or remaining in a Class "B" licensed tavern between the hours of 2 a.m. and 6 a.m.; or 2:30 a.m. to 6 a.m. on Saturday and Sunday. This ordinance does not apply to hotels, restaurants, bowling alleys, athletic clubs, country clubs, lodges, and social or fraternal organizations, which may remain open for the conduct of their regular business or activities, but may not sell any intoxicating liquor or fermented malt beverages during prohibited hours.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 90-15-3-a-3 of the code is created to read:
90-15. Hours of Operation.
3. CLASS "B" FERMENTED MALT BEVERAGE AND INTOXICATING LIQUOR RETAILER LICENSES OR CLASS "B" SERVICE BAR LICENSE.
a-3. No patron shall enter or remain on the licensed premises during the hours specified in subd.1.
Part 2. Section 90-15-5 of the code is created to read:
5. PENALTY. A patron who is convicted of violating subd. 3-a-3 shall be subject to a forfeiture of not more than $250 and in default thereof, shall be imprisoned in the county jail or house of correction for a period not to exceed 10 days.
