Analysis
This resolution will result in the sale of vacant, tax-deed lot.
Body
Whereas, Robert W. Kilps and Sally J. Kilps have submitted an Offer to Purchase the vacant, tax-deed lot at 1813-15 North 5th Street, Tax Key No. 353-0896-3, in the amount of $1,875; and

Whereas, Mr. and Ms. Kilps are in the process of purchasing the adjoining vacant lot, which they will combine with said lot to create one 50' x 150' lot for construction of an owner-occupied single-family home; and

Whereas, Mr. and Ms. Kilps will procure a survey, which will combine the two lots into one, all at their own expense; and

Whereas, The Department of City Development (“DCD”) recommends acceptance of said offer with the property being conveyed in an “as is” condition without representations or warranties including but not limited to soil quality and subsurface condition contingent upon submittal and approval of site plans along with a firm financial commitment in an amount to complete construction as proposed; and

Whereas, The City Plan Commission has determined that said lot is surplus to municipal needs; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that said lot is declared surplus, that the offer from Robert W. Kilps and Sally J. Kilps is accepted, that the Commissioner of DCD, or assigns, is authorized and directed to perform such acts as necessary to carry out the intent of this resolution and that the proceeds from the sale, less a 20 percent development fee to the Redevelopment Authority of the City of Milwaukee, be credited to the Reserve For Tax Deficit Fund Account No. 0001-334106.
