This resolution authorizes a total payment of $200,000.00 from the Damages and Claims Fund, for the purpose of settling the claim filed relative to the death of Mario Mallett, to the claimants and the claimants' attorneys.
Body
Whereas, Mario Mallett died in police custody in December of 2001, and his estate, surviving spouse, child and parents have filed a claim, asserting police and municipal liability; and
Whereas, It is in the City's best interests to settle this case for a total sum of $200,000.00; and
Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to pay this settlement; now, therefore be it
Resolved, By the Common Council of the City of Milwaukee, that the proper City officers be and are hereby authorized and directed to authorize the expenditure of two City checks, one in the amount of $18,000.00, made payable to Allstate Assignment Company, and the second in the amount of $182,000.00, made payable to the Client Trust Account of the Law Offices of Domnitz, Mawicke & Goisman, S.C., in full and final resolution of this claim, said amount to be charged to the Damages and Claims Fund, Account No. 0001-1490-0001-S118-006300; and, be it
Further Resolved, That Common Council File Nubmer 030198, adopted by teh Common Council on June 3, 2003, is hereby rescinded.
