Whereas, The above-captioned case concerns a personal injury action; Milwaukee County Case No. 02-CV-000495, seeking compensation for injuries sustained by plaintiff Beth Ann Kralik in an automobile collision which occurred on January 24, 1999; and
Whereas, The City has a subrogation claim of $13,877.07 for medical payments made pursuant to its Basic Health Plan on behalf of Beth Ann Kralik for treatment of injuries allegedly sustained in connection with the accident; and
Whereas, Plaintiff has offered the City the amount of $1,500.00 in settlement of its subrogation claim; and
Whereas, The amount offered is a fair and reasonable settlement of the City's subrogation claim; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that an authorized representative of Wisconsin Physicians Service Insurance Corporation, the claims administrator for the Basic Health Plan, be and hereby is authorized and directed, on behalf of the City, to accept the settlement of $1,500.00 in release and satisfaction of the City's subrogation claim against Beth Ann Kralik.
