Analysis
This resolution directs the Department of Administration - Intergovernmental Relations Division to seek introduction and passage of state legislation which requires the payment or the arrangement of adjudication of outstanding parking citations prior to the release of towed and impounded motor vehicles.
Body
Whereas, Section 101-25 of the Milwaukee Code of Ordinances provides for the release of a towed and impounded motor vehicle when the owner pays the towing and storage charges, even when outstanding parking citations for that vehicle remain unpaid; and

Whereas, State law does not expressly authorize the City of Milwaukee to retain an
impounded vehicle until all outstanding parking citations for that vehicle are paid; and

Whereas, Unpaid parking citations constitute an overdue debt that the vehicle owner owes to the City, and that should be paid or adjudicated before a towed vehicle is released to its owner; and

Whereas, The City Attorney's Office has taken the position that the State Legislature should grant express authority before the City enacts an ordinance to require payment or adjudication of outstanding parking citations for an impounded motor vehicle; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Department of Administration - Intergovernmental Relations Division is directed to seek introduction and passage of state legislation which requires the payment or the arrangement of adjudication of outstanding parking citations prior to the release of towed and impounded motor vehicles.
