Title
Substitute resolution to vacate the alleys in the block bounded by West Galena Street, West Walnut Street, North 16th Street and North 17th Street and the right-turn bypass at the Southeast corner of West Walnut Street and North 17th Street, in the 17th Aldermanic District.
Analysis
This substitute resolution vacates the above alleys and right-turn bypass in accordance with vacation proceedings under power granted to the City of Milwaukee by Section 66.297(1), Wisconsin Statutes, and Section 81-308-28, Milwaukee Code of Ordinances. This vacation was requested by the Redevelopment Authority of the City of Milwaukee for consolidation of land for future sale and development of single-family homes.
Body
Whereas, It is proposed that the alleys in the block bounded by West Galena Street, West Walnut Street, North 16th Street and North 17th Street and the right-turn bypass at the Southeast corner of West Walnut Street and North 17th Street be vacated pursuant to the provisions of Section 62.73, Wisconsin Statutes; and
Whereas, The Department of Public Works has been authorized and directed to prepare a coordinated report estimating all costs and benefit assessments that will be incurred with said vacation; and
Whereas, Said vacation has been reviewed in accordance with Sections 81-116-1 and 308-28, Milwaukee Code of Ordinances; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that said alleys and right-turn bypass as indicated by Exhibit A and bound and described by:
Right-Turn Bypass: That part of North 17th Street in the Southeast 1/4 of Section 19, Township 7 North, Range 22 East, described as follows:
Commencing at the point of intersection of the present south line of West Walnut Street and the present east line of North 17th Street; thence Southwesterly, along said present east line and its extension, to a point in the north line of Lot 14 in Block 8 of Plankinton's Addition, a recorded subdivision, in said 1/4 Section, said point lying 1.93 feet East of the present east line of North 17th Street as opened to the South; thence West, along said north line and the present east line of North 17th Street, 1.93 feet to a point in said present east line; thence North, along the northerly extension of said present east line as opened to the South, to its point of intersection with the westerly extension of the present south line of West Walnut Street; thence East, along said westerly extension, to the point of commencement.
Alleys: All of the Northerly and Southerly East-West 15-foot wide alleys and the North-South 20-foot wide alley in Block 8 of Plankinton's Addition, a recorded subdivision, in the Southeast 1/4 of Section 19, Township 7 North, Range 22 East, within the area bounded by the north line of West Galena Street, the present south line of West Walnut Street, the west line of North 16th Street and the present east line of North 17th Street, is vacated; and, be it
Further Resolved, That upon deposit of the funds required, the Commissioner of Public Works and/or the City Engineer are authorized to implement actions listed in the coordinated report relating to said vacation; and, be it
Further Resolved, That as provided by Section 80.32(4), Wisconsin Statutes, said vacation shall not terminate the easements and rights incidental thereto acquired by or belonging to any county, town, village or city, or to any utility or person in any underground structures, improvements or services, as enumerated or otherwise existing in said description of land above described, both easements and rights and all rights of entrance, maintenance, construction and repair with reference thereto shall continue as if said alleys and right-turn bypass had not been vacated.
