Analysis
Common Council File Number 001273 (enacted January 16, 2001) declared certain illegal activities to be nuisances and established a process under which the owners of properties at which nuisances repeatedly occur can be held financially liable for the cost of providing police protection to these properties. This ordinance expands the list of illegal activities declared to be public nuisances to include the following:
1. The sale, offering for sale, bartering or giving away of any intoxicating liquors or fermented malt beverages without a license.
2. The operation of a convenience store in violation of the city's convenience store provisions.
3. The sale of tobacco products to those under the age of 18.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. Section 80-10-2-a-19 and 20 of the code is renumbered 80-10-2-a-22 and 23.

Part 2. Section 80-10-2-a-19 to 21 of the code is created to read:

80-10. Chronic Nuisance Premises.

2. DEFINITIONS.

a-19. The sale, offering for sale, bartering or giving away of any intoxicating liquors or fermented malt beverages without a license as provided in s. 90-3-1 of the code or s. 125.04(1), Wis. Stats.

a-20. The operation of a convenience store in violation of any provision of s. 68-4.3.

a-21. Selling or giving away tobacco products to persons under the age of 18 as defined in s. 106-30-2.
