Resolution authorizing an amendment to the agreement between the City of Milwaukee and CityNet Telecommunications.
Analysis
Common Council File Number 010956 (adopted April 23, 2002) authorized and directed the appropriate City officials to execute an agreement with CityNet Telecommunications permitting the latter to use portions of the City's sewer system for the installation of so-called "dark fiber". Part of the resulting agreement required CityNet to make a $50,000 payment to the City within 180 days after the effective date of the agreement. CityNet has now offered, however, in place of this payment, to conduct a "broadband audit" for the City analyzing supply and demand and providing specific recommendations relating to improving the City's telecommunications capabilities. This resolution authorizes this change.

Whereas, Common Council File Number 010956, adopted April 23, 2002, authorized and directed the appropriate City officials to execute an agreement with CityNet Telecommunications, permitting the latter to use portions of the City's sewer system for the installation of "dark fiber"; and

Whereas, One of the terms of this agreement required CityNet to make a $50,000 payment to the City within 180 days after the effective date of the agreement; and

Whereas, CityNet has since offered to conduct a "broadband audit" for the City in exchange for the City agreeing to forego the $50,000 payment; and

Whereas, This audit would result in significant benefits to the City, analyzing the available supply of and demand for Internet resources and making specific recommendations for the improvement of the City's telecommunications capabilities; now, therefore, be it
