This resolution authorizes the City Engineer to petition the Office of the Commissioner of Railroads of the State of Wisconsin in order to file a complaint against the Wisconsin & Southern Railroad Company to maintain the railroad crossing on North 107th Street approximately 800 feet south of West Brown Deer Road.
Body
Whereas, The Wisconsin & Southern Railroad Company (WSOR) is responsible for maintenance of the at-grade railroad crossing on North 107th Street, approximately 800 feet south of West Brown Deer Road, per Section 86.12 of the Wisconsin Statutes; and

Whereas, Section 86.12 states that railroad companies owning and/or operating on tracks which cross streets or highways at grade must keep the surface of those crossings, including 4 feet on either side of the tracks, in good condition and repair for highway travel; and

Whereas, The crossing has not been properly maintained by the railroad, and complaints have been received from the public regarding the poor condition of the crossing; and

Whereas, Correspondence sent to WSOR requesting that they maintain the crossing, per Section 86.12 of the Wisconsin Statutes, has gone unanswered and the crossing remains a nuisance in the public right-of-way and improperly maintained; now, therefore, be it
