Resolution granting permission to the Milwaukee Metropolitan Sewerage District to place and maintain monitoring wells in the public right-of-way at several locations throughout the City, in several aldermanic districts. (Infrastructure Services Division)
Analysis
This resolution authorizes and directs the Commissioner of Public Works to now issue all necessary permits to the Milwaukee Metropolitan Sewerage District for the installation of monitoring wells in the public right-of-way at several locations throughout the City.
Body
Whereas, The Milwaukee Metropolitan Sewerage District (MMSD) wishes to place monitoring wells in the public right-of-way at several locations throughout the City to monitor the groundwater levels during construction of new sewers; and
Whereas, The proposed monitoring wells may only occupy the public right-of-way with Common Council approval; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works is hereby authorized and directed to issue all necessary respective permits for installation of monitoring wells at the following locations:
1. In West Scott Street, 40 feet east of the eastline of South 4th Street and 24 feet north of the southline of West Scott Street.
2. In South Barclay Street, 45 feet north of the northline of East Scott Street and 10 feet east of the westline of South Barclay Street.
3. In the southerly on-ramp to I-94, 36 feet west of the east curbline of South 6th Street and 6 feet north of the southerly curbline.
4. In East Erie Street, 35 feet south of the southline of East Corcoran Street and 20 feet northeasterly of the southline of East Erie Street.
5. In North 6th Street 30 feet north of the northline of West Clybourn Street and 16 feet east of the westline of North 6th Street,
6. In the northbound roadway of North 6th Street, 9 feet east of the median and 10 feet north of the northline of West Clybourn Street.
7. In East Erie Street, 55 feet southwesterly of the northline of East Erie Street and 74 feet southeasterly of the southline of East Polk Street.
8. In East Buffalo Street, 8 feet east of the eastline of North Milwaukee Street and 23 feet north of the southline of East Buffalo Street.
9. In North Milwaukee Street, 16 feet west of the eastline of North Milwaukee Street and 22 feet north of the northline of East Mason Street.
10. In East Clybourn Street, 30 feet west of the westline of North 2nd Street and13 feet south of the northline of East Clybourn Street.
11. In West Clybourn Street, 25 feet east of the eastline of North 4th Street and 25 feet south of the northline of West Clybourn Street
12. In North 11th Street, 14 feet west of the eastline of North 11th Street and 61 feet north of West Michigan Street.
13. In North Milwaukee Street, 30 feet west of the eastline of North Milwaukee Street and 211 feet north of the northline of East St. Paul Avenue.
14. In East Clybourn Street, 35 feet east of the eastline of North Water Street and 10 feet south of the northline of East Clybourn Street.
15. In West Michigan Street 23 feet east of the eastline of North 9th Street and 13.5 feet south of the northline of West Michigan Street
16. In West Michigan Street 37 feet east of the eastline of North 8th Street and 12 feet south of the northline of West Michigan Street.
17. In East Kilbourn Avenue 8 feet east of the eastline of North Milwaukee Street and 17 feet south of the northline of East Kilbourn Avenue.
Further Resolved, That this permission is granted only on the conditions that the MMSD shall:
1. Hold the City of Milwaukee or its agents harmless and accept responsibilty for any and all liabilities that may arise through implementations of the permission granted herein.
2. Obtain the necessary Department of Public Works permits prior to installation of the monitoring wells and any other related items within the right-of-way.
3. During the time that the monitoring wells are in place within the public right-of-way, the MMSD shall, upon notification, be responsible for any work found necessary to the wells as a result of any City of Milwaukee construction or maintenance project.
4. Whenever the monitoring wells are no longer needed or when so ordered for public necessity, not only remove these items but shall also restore to its former condition and to the approval of the Commissioner of Public Works any public improvement which was removed, changed or disturbed by reason of the granting of this resolution. Grantee shall not be entitled to any damages for such removal.
