Whereas, The Outside Counsel/Expert Witness Fund Special Purpose Account is to be used by the City Attorney's Office for the purpose of retaining experts and outside legal counsel; and
Whereas, Mario Mallet died in police custody in December of 2001, and his estate and surviving spouse have filed a claim, asserting police and municipal liability; and
Whereas, It would be in the City's best interest to retain an expert to assist in evaluating the issues raised at this stage of litigation; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the expenditure of $10,000 is authorized from the Outside Counsel/Expert Witness Fund Number 0001 9990 S157 006300 to the City Attorney's Office for the purpose of paying expert witnesses and other litigation costs related to evaluating the Mallett claim; and, be it
Further Resolved, That the City Attorney is authorized to pay litigation expenses and expenses of the expert witnesses after review and approval of invoices; and, be it
Further Resolved, That the City Comptroller is authorized and directed to make whatever fund transfers are necessary or appropriate to carry out the provisions of this resolution; and, be it
Further Resolved, That the application of these appropriated funds to a case other than the one referred to herein shall be subject to the further direction and approval of the Common Council.
