Title
Substitute resolution relative to application, acceptance, and funding of a Wisconsin Department of Natural Resources Urban Nonpoint Source and Storm Water Management Grant.
Analysis
This substitute resolution authorizes the Department of Public Works, Infrastructure Service Division to apply for, accept and fund an Urban Nonpoint Source and Storm Water Management Grant from the Department of Natural Resources in the amount of $150,000 with a City share of $150,000 and a grantor share of $150,000.  The Grant is allocated to fund the construction of Structural Best Management Practices at various City yards.  Funding under this grant will enable the City to control pollutants and improve water quality.
Body
Whereas, The City of Milwaukee appears to be eligible for grant funds from the Department of Natural Resources for the construction of Best Management Practices (BMPs) at various City yards.
 
Whereas, The purpose of this project is to improve the quality of storm water runoff, which will improve water quality; and
 
Whereas, The operation of this Urban Nonpoint Source and Storm Water Management Grant from "date" to "date" would cost $300,000 of which, $150,000 (50%) would be provided by the City and $150,000 (50%) would be provided by the grantor; and
 
Whereas, Under the terms of Section 144.25 of the Wisconsin Statutes and Chapter NR 120.08 of the Wisconsin Administrative Code, the City of Milwaukee is eligible for additional grant funds from the Department of Natural Resources for Nonpoint Source Water Pollution Abatement Nonpoint Source Grant; and
 
Whereas, It would appear that the City involvement in a grant aid project involving Storm Water quality would result in the following major benefits to the City: controlling pollutants entering the City's storm sewer system and improving water quality; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that application to the Department of Natural Resources is authorized and the Department of Public Works shall accept this grant without further approval unless the terms of the grant change as indicated in Common Council File 940843 (Grant Ordinance); and, be it
 
Further Resolved, That the City Comptroller is authorized to:
 
1.  Commit funds within the Project/Grant Parent of the "Year" Capital-Grant and Aids Projects, the following amounts for the program/project titled Urban Nonpoint Source and Storm Water Management Grant.

2.      Create a Special Revenue Fund - Grant and Aid Projects and the Necessary Project/Grant Chartfield Values at the Project, Segment, Phase and/or Activity Levels; and to budget to the Project, Segment, Phase and/or Activity Level the amount required under the grant agreements.
 
3.      Establish the necessary City share Project Values; and, be it
 
Further Resolved, That the funds are appropriated to the Department of Public Works/Infrastructure Service Division which is authorized to expend from the amount budgeted for specific purposes as indicated in the grant budgets and incur costs consistent with the award date; and, be it
 
Further Resolved, That the Commissioner of the Department of Public Works shall have the authority to authorize transfers within the project budget so long as the amount expended for any purpose shall not exceed the amount authorized by the budget by 10% and such transfers are in accordance with grantor regulations; and, be it
 
Further Resolved, That the Commissioner of the Department of Public Works on behalf of the City of Milwaukee be authorized to enter into subcontracts (and leases) as detailed in the project budget and in accordance with City purchasing procedures and Grant and Aid Guidelines for awarding such contracts; and, be it
 
Further Resolved, That the funds for the $150,000 local share of the expenditure shall be authorized in a future borrowing resolution in accordance with procedures set forth by the Public Debt Commission.
