Whereas, There will be a shortage in the Damages & Claims Fund; and
Whereas, Budgeted funds are insufficient because of the large judgment recently affirmed on appeal in Oconomowoc Residential Programs, Inc., et al. v. City of Milwaukee that has been submitted for approval; and
Whereas, Additional funding is necessary to fulfill the City's legal obligations; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the sum of $590,912.81 shall be reserved within the 2002 Common Council Contingent Fund (Account No. 0001-9990-0001-C001-006300-2002) for the City Attorney Damages & Claims Fund (Account No. 0001-1490-0001-S118-006300-2002); and, be it
Further Resolved, That the City Comptroller is authorized to appropriate on an as-needed basis up to $590,912.81 from the funds reserved within the Contingent Fund, sub-class C001 to the special sub-class S118 under the control of the City Attorney for the purpose of paying expenditures relating to legal obligations mentioned above.
