Title
A substitute ordinance amending the description of the dock and wharf line of the right bank of the Milwaukee River, north of West Wells Street.

Analysis
This ordinance amends the description of the dock and wharf line of the right (west) bank of the Milwaukee River, immediately north of West Wells Street, such that the dock and wharf line is moved in the direction of the river. This change is necessary to allow construction of a permanent building on the RiverWalk at this location.
Body
Whereas, One of the primary objectives of the RiverWalk is to stimulate economic development along the Milwaukee River in downtown Milwaukee; and
Whereas, The segment of the RiverWalk located on the west side of the river, between West Wells Street and West Kilbourn Avenue, includes a widened portion just north of West Wells Street that is intended and well-suited to accommodate new commercial activity at this location; and
Whereas, The owner of the Cawker Building, 108 West Wells Street, wishes to construct a building addition on this widened portion of the RiverWalk in conjunction with development of a restaurant on the first floor of the building; and
Whereas, The opening of a restaurant along this segment of the RiverWalk is consistent with the goal of encouraging additional commercial activity along the Milwaukee River; and
Whereas, Construction of permanent buildings beyond the dock and wharf line of the Milwaukee River is prohibited by s. 118-19 of the Milwaukee Code of Ordinances; and
Whereas, A substantial portion of the RiverWalk segment in question extends beyond the dock and wharf line, thereby severely limiting commercial use of the RiverWalk at this location; now, therefore
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 118-2-4 of the code is amended to read:
118-2. Milwaukee River (Right Bank of).
4. W. HIGHLAND AVENUE TO W. WELLS STREET. Beginning at a point on the south line of W. Highland avenue distant 156.41 feet easterly from the east line of N. Third street; running thence south 02 degrees, 06 minutes, 58 seconds west 200.14 feet to a point on the north line of the alley in block 48, plat of the town of Milwaukee on the west side of the river, northeast ΒΌ, section 29, township 7 north, range 22 east, said point being distant 152.00 feet easterly from the east line of N. Third street; running thence south 00 degrees, 59 minutes, 44 seconds west 286.40 feet to a point being 14.00 feet northerly from the south line of W. State street, distant 150.09 feet easterly from the east line of N. Third street; running thence south 24 degrees, 14 minutes, 27 seconds east 171.59 feet to a point; running thence south 26 degrees, 25 minutes, 21 seconds east 348.87 feet to a point; running thence south 32 degrees, 41 minutes, 38 seconds east 112.30 feet to a point on the north line of the north alley in block 57, plat of the town of Milwaukee on the west side of the river, and distant 119.00 feet northeasterly from the northeasterly line of N. Plankinton avenue; running thence south 35 degrees, 14 minutes, 55 seconds east, 140.73 feet to a point on the division line between lots 7 and 8 of said block 57, distant 126.58 feet northeasterly from the northeasterly line of N. Plankinton avenue; running thence south 34 degrees, 15 minutes, 10 seconds east 61.01 feet to a point on the south line of the south alley in said block 57 and distant 128.81 feet northeasterly from the northeasterly line of N. Plankinton avenue, running thence south 32 degrees, 41 minutes, 38 seconds east [[240.90]] >>100.45 feet to a point, running thence north 56 degrees, 25 minutes, 31 seconds east 30.13 feet to a point; running thence south 33 degrees, 12 minutes, 58 seconds east 45.39 feet to a point; running thence south 11 degrees, 46 minutes, 17 seconds west 5.57 feet to a point; running thence south 57 degrees, 15 minutes, 31 seconds west 13.16 feet to a point; running thence south 31 degrees, 35 minutes, 00 seconds east 11.33 feet to a point; running thence south 56 degrees, 22 minutes, 51 seconds west 13.26 feet to a point; running thence south 32 degrees, 41 minutes, 38 seconds east 80.00<< feet to a point on the southeasterly line of W. Part 2. This ordinance shall take effect and be in force from and after its passage and publication; however, it shall not take effect until concurred in by the Wisconsin Department of Natural Resources.
