Substitute resolution authorizing Amendment to Intergovernmental Cooperation and Development Agreement – Indian Council of the Elderly Project.

Analysis

This resolution authorizes an Amendment and Supplement to the Intergovernmental Cooperation and Development Agreement – Indian Council of the Elderly Project to allow construction of the public improvements provided for in that agreement by the Developer pursuant to a contract with the City of Milwaukee Department of Public Works.

Body

Whereas, The City entered into an Intergovernmental Cooperation and Development Agreement – Indian Council of the Elderly Project dated as of April 30, 2001 ("Development Agreement"); and

Whereas, Section 3.1(g) of the Development Agreement provides for the construction of certain public improvements by the City; and

Whereas, The City, the Private Parties, and the Developer (collectively "Developer"), as referenced in the Development Agreement, desire to provide for an Amendment and Supplement to the Development Agreement solely for the purpose of allowing the Developer to construct the Public Improvements pursuant to a contract with the City of Milwaukee Department of Public Works; and

Whereas, Approval of the Amendment and Supplement to Development Agreement authorizes execution both of the Amendment and Supplement and of a contract for construction of the public improvements, in a form acceptable to the Commissioner of Public Works; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee the Amendment and Supplement to the Intergovernmental Cooperation and Development Agreement – Indian Council of the Elderly Project and the contract for construction of public improvements are hereby approved; and, be it,

Further Resolved, That the proper City officers are hereby authorized and directed to execute the Amendment and Supplement to the Intergovernmental Cooperation and Development Agreement and the contract for construction of public improvements on behalf of the City of Milwaukee
