Analysis
This resolution approves an Out-of-Program Agreement between the City of Milwaukee and New Land Enterprises, LLP pertaining to design, construction, and funding of public improvement alterations related to a proposed residential high-rise building to be constructed at the southwest corner of North Prospect and East Kilbourn Avenues. The Department of Public Works would design the public improvement alterations, construction responsibilities would be shared, with some work being performed by the developer and some by City forces. Department of Public Works staff will inspect all work. All costs will be assumed by the developer.
Body
Whereas, New Land Enterprises, LLP proposes to construct a high-rise residential building to be known as Kilbourn Tower at the southwest corner of East Kilbourn and North Prospect Avenues; and

Whereas, This project will require alterations to existing public improvements located in the public rights-of-way adjacent to the site; and

Whereas, An Out-of-Program Agreement outlining how these public improvement alterations will be designed, constructed, and financed has been prepared and is attached to the file; and

Whereas, That agreement stipulates that the City will design the facilities, either the City or the developer will perform the required alterations, the City will inspect the work, and the developer will assume all costs; and

Whereas, The Out-of-Program Agreement for the proposed development is attached to this file; now, therefore, be it
