Title
A substitute ordinance restricting the granting of Class "A" retailer's intoxicating liquor and Class "A" fermented malt beverage retailer licenses.

Analysis
This ordinance codifies a provision contained in resolutions in effect since June 1976, prohibiting the granting of a Class "A" fermented malt beverage retailer license to an applicant for a premises currently licensed as a filling station.  The ordinance further prohibits the granting of a Class "A" retailer's intoxication license to a filling station.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
 
Part 1.  Section 90-4.7 of the code is created to read:
 
90-4.7.      Restriction on Granting of Class "A" Fermented Malt Beverage Retailer Licenses.
 
No Class "A" retailer's intoxicating liquor license or Class "A" fermented malt beverage retailer license may be granted to an applicant applying for a premises currently licensed as a filling station.
 
Part 2.  Resolution File Number 76-220-a is rescinded.
