Title
Substitute resolution approving the Public Improvement Development and Maintenance Agreement for the Downer Avenue Merchants Association, Downer Avenue Streetscaping, between the City of Milwaukee and the Downer Avenue Merchants Association.
Analysis
The Downer Avenue Merchants Association streetscaping project proposes the installation of Milwaukee lantern and harp lighting on Downer Avenue between East Webster Place and East Park Place. The Public Improvement Development and Maintenance Agreement details the responsibilities of the City and the Downer Avenue Merchants Association for the construction, maintenance and financing of the project.

Whereas, The 2002 Capital Budget for the City of Milwaukee ("City") contains $25,000 in the Development Fund; and
Whereas, The City has an ongoing commitment to the revitalization of neighborhood commercial districts; and
Whereas, The Downer Avenue Merchants Association ("DAMA") began in 1955; and
Whereas, The DAMA has consistently invested its time and resources toward the improvement of the Downer Avenue commercial neighborhood district; and
Whereas, The DAMA has proposed a streetscaping improvement project to enhance said district; and
Whereas, Private funds will exceed the amount of City funds for the streetscaping project; and
Whereas, A Public Improvement Development and Maintenance Agreement Term Sheet for said project, a copy of which is attached to this Common Council File, has been prepared with the participation of the DAMA and City departments; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the proper City officials are authorized and directed to draft said Agreement, which is consistent with said Term Sheet and mutually acceptable to the City Attorney, the Commissioner of the Department of City Development and the Downer Avenue Merchants Association; and, be it
Further Resolved, That the City Comptroller is authorized and directed to transfer $25,000 from the Development Fund Account No. UR033010000 to the project expenditure account, Account No. UR03393700; and, be it
Further Resolved, That the City Comptroller, in conjunction with the Commissioner of the Department of City Development, is authorized and directed to establish any and all subaccounts and follow the City guidelines necessary to maintain the fiscal control to carry out the intent and purpose of this resolution; and, be it
Further Resolved, That all City officials, departments, boards and commissions are authorized and directed to assist and cooperate with said project.
