Title

Analysis
This resolution will result in the sale of a vacant, tax-deed lot for residential construction.
Body
Whereas, James and Regina Wright have submitted an unsolicited Offer to Purchase a portion of the vacant, tax-deed lot at 4029 North 11th Street, Tax Key No. 243-0042-8, in the amount of $10,000 for construction of an owner-occupied single-family home; and

Whereas, The Department of City Development ("DCD") recommends acceptance of said Offer contingent upon closing within 90 days of Offer acceptance, site and building plan approval by DCD's Planning Division, proof of a financial commitment in place to complete the construction as proposed and construction to be completed within 12 months from the date of adoption of this resolution; and

Whereas, DCD reserves the right to sell only a portion of the lot if the buyers' plans do not result in proper lot coverage; and

Whereas, The City of Milwaukee will retain the west 25 feet for future dedication and improvement as a public alley; and

Whereas, DCD recommends sale in an "as is" condition without representations or warranties including but not limited to soil quality and subsurface condition; and

Whereas, The City Plan Commission has determined that a portion of said lot is surplus to municipal needs; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the development portion of said lot is declared surplus; and, be it

Further Resolved, That said Offer to Purchase is accepted and that the proper City officials are authorized and directed to perform such acts as necessary to carry out the intent of this resolutio...
