Resolution approving an Out-of-Program Agreement between the City of Milwaukee and Gordon Knoll LLC regarding the design, construction and funding of public sewer improvements to support a proposed multi unit residential building to be located at 1120 East Locust Street. (DPW)
ANALYSIS
This resolution approves an Out-of-Program Agreement between the City of Milwaukee and Gordon Knoll LLC, a private developer. The agreement outlines how sewer improvements required for in conjunction with the developer's planned multi unit residential building to be located at 1120 East Locust Street will be designed, constructed and funded. The agreement provides that the City will design the sewer improvements and will let the contract for their construction all at the developer's expense.
BODY
Whereas, Gordon Knoll LLC proposes to develop a multi unit residential building on vacant land located at 1120 East Locust Street; and

Whereas, Development of this building will only be possible if certain improvements are made to the combined sewers in the immediate vicinity; and

Whereas, An Out-of-Program Agreement has been prepared between the City of Milwaukee and Gordon Knoll LLC covering the design, construction and funding of these combined sewer improvements; and

Whereas, Gordon Knoll LLC will provide all of the funds required to undertake the sewer improvements while the City will design and let contracts for their construction; and

Whereas, The Out-of-Program Agreement is attached to this file; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the Out-of-Program Agreement attached to the file is hereby approved and the appropriate City Officials are hereby authorized to execute it; and, be it

Further Resolved, That the Commissioner of Public Works is authorized to make minor, non-substantive changes in the agreement prior to its executio...
