Analysis
This resolution authorizes and directs the Commissioner of Public Works to execute the Project Agreement with the Wisconsin Department of Transportation for the programming and construction of the Marsupial Bridge.  The Marsupial Bridge is a bicycle/pedestrian bridge that will be suspended from the Holton Street Viaduct.  The project will be funded 80 percent by Congestion Mitigation and Air Quality (CMAQ) funds, with the remaining 20 percent being paid by Tax Incremental District No. 22 funds.
Body
Whereas, The City of Milwaukee has actively promoted the expansion of bicycle and pedestrian facilities; and
 
Whereas, The Brady Street Business Improvement District (B.I.D. #11) has proposed a project known as the Marsupial Bridge, that would provide a vital link to the bicycle and pedestrian route system just north of downtown Milwaukee; and
 
Whereas, The Marsupial Bridge would connect the neighborhoods on each side of the Milwaukee River; and
 
Whereas, Bicycle and pedestrian projects such as the Marsupial Bridge proposal are eligible for the state's Congestion Mitigation and Air Quality (CMAQ) program; and
 
Whereas, The City of Milwaukee applied for CMAQ funds to design and construct the Marsupial Bridge; and
 
Whereas, The Wisconsin Department of Transportation (WISDOT) has approved this application and submitted a Project Agreement to be executed by the City of Milwaukee for the programming and construction of the project with federal aid under the CMAQ program; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works (CPW) is hereby authorized and directed to execute the Project Agreement for the programming and construction of the Marsupial Bridge that will suspend under the Holton Street Viaduct, a copy of which is attached to Common Council File Number 020210, and is incorporated in this resolution by reference as though set forth in full; and, be it
 
Further Resolved, That the CPW is hereby authorized and directed to undertake or engage a consultant to undertake preliminary engineering for the above mentioned project and to reimburse the WISDOT for preliminary engineering costs they incur for the improvement; and, be it
 
Further Resolved, That the City Comptroller is hereby authorized to create with the Capital Improvement Fund, Grant and Aid Projects, the necessary Project/Grant Chartfield values for preliminary engineering for the project (Expenditure), and transfer to these accounts the amount required under the grant agreement and City Accounting Policy, but not to exceed a 10 percent increase of the total amounts reserved for the grantor's share and local share or  $5,000, whichever is greater, as follows:

Further Resolved, That the City Engineer is hereby authorized and directed to approve and make periodic payments to the WISDOT upon receipt of invoices for the local share of the project.
