Analysis

This resolution approves an Out-of-Program Agreement between the Heritage Meadows Land Company and the City of Milwaukee regarding the design, construction and funding of public improvements to support an 18 lot single family home subdivision to be located generally west of North 110th Street, south of West Heritage Drive, east of North 114th Street and north of West Meadowcreek Drive.  The agreement provides that the Developer pay for all the public improvements.  The City will design the improvements and inspect their construction.  The agreement further provides that either the City or the Developer may construct the improvements at the discretion of the Commissioner of Public Works.

Body

Whereas, Heritage Meadows Land Company, a developer, desires to enter into an Out-of-Program Agreement with the City of Milwaukee regarding the design and installation of public improvements to serve an 18 lot single family residential subdivision known as Heritage Meadows Addition No. 2; and

Whereas, Heritage Meadows Addition No. 2 is generally located south of West Heritage Drive, west of North 110^th Street, east of North 114^th Street and north of West Meadowcreek Drive; and

Whereas, The Out-of-Program Agreement for the development is attached to this file; and

Whereas, Under the terms of the agreement the proposed public improvements would be designed and installed at no cost to the City of Milwaukee; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the Out-of-Program Agreement attached to this file is hereby approved and the proper City Officers are hereby authorized to execute said agreement on behalf of the City of Milwaukee; and, be it

Further Resolved, That under the terms of the Out-of-Program Agreement it will be necessary to do the following described public improvements in accord with City specifications:

15^th Aldermanic District

West Sanctuary Drive - North 110^th Street to North 113^th Street (WT430023002):  Water main extension (Developer Water Fund - $5,000)

North 113^th Street - 200 feet South of West Sanctuary Drive to 200 feet North of West Sanctuary Drive (WT430023003) Water main extension (Developer Water Fund - $5,000); and, be it

Further Resolved, That all City Departments are authorized to perform engineering, surveys, plan preparation, and determine an estimated cost thereof; and, be it

Further Resolved, That the City Comptroller is authorized and directed to transfer such funds which are available for this purpose to the appropriate capital Project/Grant accounts; and, be it

Further Resolved, That the Commissioner of Public Works is authorized to make minor, non-substantive changes to the Out-of-Program Agreement prior to its execution.
