Analysis
This resolution will result in the sale of a vacant, tax-deed lot for parking purposes.
Body
Whereas, Mitchell Park Plaza, owned by Alvin H. Brusky Revocable Trust D 12-23-1994, Alvin H. Brusky, Trustee, is a strip mall shopping center located on South 27th Street between West Pierce Street and West National Avenue; and

Whereas, Alvin H. Brusky, Trustee, has offered $5,000 to purchase the adjoining vacant, tax-deed lot at 730-32 South 28th Street, Tax Key No. 435-9998-110-2, for development of a parking lot which will be rented by Enterprise Rent-A-Car; and

Whereas, The Department of City Development ("DCD") recommends acceptance of this unsolicited Offer to Purchase contingent upon site plan approval by DCD's Development Center, proof of a financial commitment in place for the development, and completion of improvements within two months from the date of plan approval; and

Whereas, DCD recommends sale in an "as is" condition without representations or warranties including but not limited to soil quality and subsurface condition; and

Whereas, The City Plan Commission has determined that said lot is surplus to municipal needs; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that said lot is declared surplus; and, be it

Further Resolved, That the unsolicited Offer to Purchase from Alvin H. Brusky, Trustee, is accepted and that the Commissioner of DCD, or assigns, is authorized and directed to perform such acts as necessary to carry out the intent of this resolution with the proceeds from sale, less a 15 percent development fee to the Redevelopment Authority of the City of Milwa...
