Analysis
This resolution directs the Department of Administration - Intergovernmental Relations Division to seek introduction and passage of legislation permitting cities to regulate underage events at establishments with Class "B" alcohol beverage licenses. Such events are permitted pursuant to s. 125.07(3)(a)(10), Wis. Stats.
Body
Whereas, Pursuant to s. 125.07(3)(a)(10), Wis. Stats., establishments with Class "B" alcohol beverage licenses are permitted to host underage events at which no alcohol is served or consumed; and
Whereas, The only regulation of these events permitted to municipalities is a requirement that the licensed establishment provide advance notice to the local police department; and
Whereas, In the time since the passage of this provision, many of these events have proven to be highly disruptive, attracting an unhealthy mixture of young people and adults and creating a public nuisance; and
Whereas, Class "B" establishments, whether they are serving alcohol beverages or not, are perceived as "bars" by young people and can thereby become centers for unusually anti-social behavior; and
Whereas, Cities have a profound interest in controlling this sort of activity, especially when it occurs at establishments often located in residential neighborhoods; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Department of Administration - Intergovernmental Relations Division, is directed to seek introduction and passage of legislation that would permit cities to regulate underage events at establishments with Class "B" alcohol beverage licenses.
