Analysis
This substitute resolution will amend the disposition of a portion of the land at 8703 West Howard Avenue to permit conveyance of a portion of the property to the City of Greenfield for park use and to permit the City of Milwaukee to dedicate or reserve portions of the City-owned property for public right of way.
Body
Whereas, On September 25, 2001, by adoption of File No. 010681, the Common Council of the City of Milwaukee approved the sale of the land at 8703 West Howard Avenue to Horizon Development Group, LLC (“Horizon”), or its assigns, for a senior housing development and open space; and
Whereas, Horizon had agreed with the City of Greenfield to dedicate approximately 3.619 acres of wooded area of the site as park use, but the City of Greenfield has requested that the land be conveyed directly from the City of Milwaukee to the City of Greenfield; and
Whereas, Said change in the Offer to Purchase is acceptable to Horizon and the purchase price remains unchanged; and
Whereas, A Certified Survey Map is currently being prepared and shall identify the area to be conveyed to the City of Greenfield as a separate legal parcel; and
Whereas, The City of Greenfield also has requested that the Certified Survey Map include on the remaining City owned property a dedication of a cul du sac with a 45-foot radius at the intersection of South 88th Street and West Waterford Avenue and a 30-foot reservation along South 88th Street for future street improvement; and
Whereas, The Water Department does not object to the dedication under the conditions that all improvements required for the right of way be made at no expense to the City of Milwaukee, that the City of Greenfield be responsible for all repair to the right of way tha...
