Title
Substitute resolution declaring platted and unimproved land on the Northwest Side surplus and authorizing the Department of City Development to accept an Offer to Purchase from the Milwaukee Metropolitan Sewerage District, in the 15th Aldermanic District.
Analysis
This substitute resolution will result in the sale of an undeveloped parcel of land to MMSD.
Body
Whereas, The City of Milwaukee acquired 57 contiguous vacant lots, identified on the plat maps attached to this Common Council File, in one tax foreclosure action in 1991; and
Whereas, The assembled parcel of approximately 27.55 acres is in a primary environmental corridor abutting the Little Menomonee River containing a designated wetland and stream; and
Whereas, The Milwaukee Metropolitan Sewerage District ("MMSD") desires to acquire this real estate for flood mitigation and conservancy purposes; and
Whereas, The Department of City Development recommends sale in an amount to be determined by an independent appraisal of fair market value in an "as is" condition without any representations or warranties including but not limited to soil and groundwater quality or any other above grade and subsurface conditions; and
Whereas, The City Plan Commission has determined that said land is surplus to municipal needs; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that said land is declared surplus; and, be it
Further Resolved, That MMSD's Offer to Purchase is accepted and that the proper City officials are authorized and directed to perform such acts as necessary to carry out the intent of this resolution with the proceeds from the sale being credited to the Reserve For Tax Deficit Fund Account No. 0001-334106.
