Resolution authorizing the proper City Officers to execute an amendment to the Intergovernmental Cooperation Agreement between the City of Milwaukee, the Board of School Directors of the Milwaukee Public Schools and the Milwaukee Metropolitan Sewerage District regarding modifications to the stormwater detention facility located at Henry David Thoreau Elementary School.
Analysis
This resolution authorizes the City Officers to execute an amendment to the Intergovernmental Cooperation Agreement (Agreement), executed on December 21, 1999, between the City of Milwaukee (City), the Board of School Directors of the Milwaukee Public Schools and the Milwaukee Metropolitan Sewerage District (MMSD) regarding the stormwater detention facility located at Henry David Thoreau Elementary School. The amended Agreement establishes new terms and conditions for the operation and maintenance of the modified detention basin between City and MMSD.

Whereas, In 1999, based on consultant recommendation and to address drainage-induced flooding along Southbranch Creek in the city of Milwaukee and the village of Brown Deer, MMSD proposed to construct a dry stormwater detention facility at Henry David Thoreau Elementary School, 7878 North 60th Street; and
Whereas, Common Council File 990459 authorized the City to enter into an Intergovernmental Cooperation Agreement with the Milwaukee Metropolitan Sewerage District and the Board of School Directors of the Milwaukee Public Schools granting MMSD an easement to property of the Henry David Thoreau Elementary School; and
Whereas; The agreement also required MMSD to construct the dry detention basin at no cost to Milwaukee Public Schools or City and assigned responsibilities for maintenance of the detention facility; and
Whereas, In 2010, MMSD modified structures appurtenant to the detention facility for relief of excess stormwater south and east of Henry David Thoreau Elementary School in the vicinity of North Edgeworth Drive such that excess stormwater can drain into the detention facility; and
Whereas, The modifications consisted of constructing a new weir structure and flap valves on the existing 72-inch sewer; and
Whereas, The amended Agreement establishes that City be responsible for the operation and maintenance of structures, pipes, storm sewers, weirs, or flap valves and MMSD be responsible for the detention basin itself; now, therefore, be it.
Resolved, That the proper City Officers are hereby authorized to execute an amended Intergovernmental Cooperation Agreement with MMSD establishing terms and conditions for the operation and maintenance of the modified detention basin between the City and the MMSD, said amended Intergovernmental Cooperation Agreement being attached to this Common Council Resolution File Number 131262 and incorporated in this resolution by reference as though set forth in full.
