Analysis
This ordinance classifies personal service establishments (e.g., barber and beauty shops, music studios and tanning salons) as special uses whenever they operate between the hours of 12 a.m. and 5 a.m. and are located within 100 feet of a residential zoning district or a residential planned development. This restriction does not apply to personal service establishments located in central business zoning districts.

This ordinance also modifies the definition of "personal services" to include tattooing and body-piercing establishments. This change is consistent with the existing City-staff practice of classifying tattooing and body-piercing businesses as personal service establishments.

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. Section 295-7-132-f of the code is created to read:

295-7. Definitions.

Part 2. Section 295-223-20 of the code is created to read:

295-223. Special Uses.

20. LATE-HOUR USES. Personal services which operate between the hours of 12 a.m. and 5 a.m. and are located within 100 feet of a district established under subchs. 8 to 12 or a residential planned development.
