Analysis
This resolution approves an Out-of-Program Agreement between Irgens Development and the City of Milwaukee. Irgens proposes to construct a new, approximately 210,000 square foot office building at 827 East Wisconsin Avenue. The project requires abandonment of existing sewer and water lines that cross the site and the construction of replacement facilities. Under the terms of the agreement, Irgens will provide all the initial funding for the required public improvement work. However, the City would subsequently reimburse Irgens for the difference in cost between reconstructing in-place the sewer that runs through the site versus the cost of a re-routed sewer around the site.
Body
Whereas, Irgens Development proposes to construct a new 210,000 square foot office building at 827 East Wisconsin Avenue; and

Whereas, This project will require abandonment of existing sewer and water lines presently located in easement across the site; and

Whereas, Replacement sewer and water lines will have to be constructed in public streets around the site; and

Whereas, An Out-of-Program Agreement specifying how these replacement facilities will be designed, constructed and financed has been prepared and is attached to the file; and

Whereas, That agreement stipulates that the City will design the facilities and will let public works contracts for their construction while the developer will provide all initial funding; and

Whereas, The sewer to be replaced was originally constructed in 1896 and even without the proposed project would require reconstruction in the relatively near future; and
