Title
Substitute resolution relative to the erection and maintenance of a sculpture by the Women's Club in the Kilbourn Avenue median between North Cass and North Marshall Streets and the preservation of the adjacent mature tree.

Analysis
This resolution amends Resolution File Number 001080, adopted November 28, 2000, which authorized an agreement between the City and the Women's Club of Wisconsin for the erection and maintenance of a sculpture in the Kilbourn Avenue median between North Marshall and North Cass Streets. It adds the following 2 conditions to this resolution:

1. A mature tree on the median is to be retained whatever the plans for the sculpture might be. The tree may only be removed if it dies, becomes diseased or otherwise becomes a hazard to health or safety.

2. Whatever landscaping plan is prepared for the median must be submitted to the Common Council for approval.

Whereas, The Common Council, on November 28, 2000, approved Council File Number 001080 being a resolution authorizing the Commission of Public Works to enter into an agreement with the Women's Club of Wisconsin for the erection and maintenance of a sculpture in the Kilbourn Avenue median between North Marshall and North Cass Streets; and

Whereas, Since that time, concerns have been raised about the final appearance of the sculpture and a surrounding landscape area as well as the fate of a mature tree currently on the median; and

Whereas, It is in the City's interest to preserve the appearance of the public median space; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that Common Council File Number 001080, adopted November 28, 2000, is amended by adding new conditions to the 4 currently enumerated in the "Resolved" clause, to wit:

"5. The mature tree currently in the Kilbourn Avenue median shall be retain...
