Substitute resolution directing the Intergovernmental Relations Division - Department of Administration to lobby for a change in recently enacted legislation related to the property damage amount for classification as a Class D felony for graffiti-related vandalism.
Analysis
This resolution directs the Intergovernmental Relations Division - Department of Administration to lobby for a change to s. 943.01(2)(d), Wis. Stats., to change the dollar amount of property damage back to $1,000 for graffiti-related vandalism, rather than the current $2,500, while leaving the dollar amount at the current $2,500 for other property damage.
Body
Whereas, The Wisconsin budget, 2001 Wisconsin Act 16, increased from $1,000 to $2,500 the amount of criminal damage to property needed to charge an individual with a Class D felony, rather than a Class A misdemeanor; and
 
Whereas, The City of Milwaukee believes that this change adversely affects its graffiti enforcement since, as a result of this change, the majority of graffiti cases in the city may only be prosecuted as misdemeanors, rather than felonies; and
 
Whereas, The City of Milwaukee feels that graffiti continues to be a citywide problem affecting individuals as well as neighborhoods and should be prosecuted as such; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Intergovernmental Relations Division - Department of Administration is directed to lobby for a change to s. 943.01(2)(d), Wis. Stats., to change the dollar amount of property damage back to $1,000 for graffiti-related vandalism, rather than the current $2,500, while leaving the dollar amount at the current $2,500 for other property damage.
