Analysis
This resolution approves the first amendment to an Out-of-Program agreement between Liberty Property Limited Partnership and the City of Milwaukee. The original agreement outlined how a new street, West Liberty Drive, would be designed, constructed and funded. The amendment provides for a change in the original design concept for the street by adding a landscaped median at the point the new street intersects West Park Place. The amendment further provides that the developer shall pay the additional cost associated with the change in street design and shall also assume responsibility for ongoing maintenance of the median's landscaping.

Whereas, On November 9, 1999, the Common Council of the City of Milwaukee approved file number 991038, said file being an Out-of-Program Agreement between Liberty Property Limited Partnership and the City of Milwaukee; and

Whereas, The approved agreement outlined how a new street, West Liberty Drive, and the associated underground public infrastructure would be designed, constructed, and funded; and

Whereas, Liberty Property has requested that the design of the street as originally contemplated be modified to include a landscaped median at the intersection of the new street with West Park Place; and

Whereas, Liberty Property has agreed to fund the full incremental construction cost of the median as well as the ongoing cost of maintaining the median's landscaping; and

Whereas, A first amendment to the approved Out-of-Program Agreement has been prepared and is attached to the file; now, therefore, be it
