Body
Whereas, As part of the 2001 Sewer Program, the City of Milwaukee will be constructing a 48-inch by 76-inch horizontal-elliptical storm sewer upon the right-of-way of the Soo Line Railroad Company at approximately 800 feet m/l west of North 41st Street between the Menomonee River and West State Street; and

Whereas, The Soo Line Railroad Company d/b/a Canadian Pacific Railway has agreed to the construction, maintenance, and use of said horizontal-elliptical storm sewer upon its property subject to the conditions set forth in a License Agreement, SL-2693 for the installation of this facility and a one time fee of $2,500 and has subsequently forwarded the Agreement to the City for execution, said Agreement is attached to this file and made part of this resolution; now, therefore, be it

Resolved, That the proper City Officers are hereby authorized to execute License Agreement, SL-2693; and, be it

Further Resolved, That the aforementioned payment to the Soo Line Railroad Company for the license fee shall be charged against the Sewer Maintenance Relay Fund account number SM495010570; and, be it

Further Resolved, That said Agreement is subject to the City Attorney's review and approval and non-substantive changes made by the City Attorney.
