This resolution grants Mark and Cynthia Mueller permission to construct a driveway in unimproved public right-of-way of East Bolivar Avenue, east of South Logan Avenue, for access to their property at 4302 South Logan Avenue.
Body
Whereas, A portion of public right-of-way, east of South Logan Avenue, which is designated as East Bolivar Avenue, is presently unimproved public right-of-way; and

Whereas, Mark and Cynthia Mueller own the property located at 4302 South Logan Avenue which is adjacent to unimproved East Bolivar Avenue; and

Whereas, Permission for private use of the unimproved public right-of-way for the construction of a driveway for access to the property can be granted in a Special Permission Agreement; and

Whereas, A Special Permission Agreement has been prepared, which specifies that Mark and Cynthia Mueller shall bear all construction and maintenance costs associated with such access; and

Whereas, Permission to allow the above persons the private use of the public right-of-way for such access can only be approved by the Common Council; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City of Milwaukee officials are authorized and directed to execute a Special Permission Agreement allowing Mark and Cynthia Mueller the private use of a portion of the unimproved public right-of-way of East Bolivar Avenue, east of South Logan Avenue, for access to their property at 4302 South Logan Avenue under the terms and co...
